1. Scope of application
The following terms and conditions apply to all orders placed via our online store. Our online store is aimed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.

Presentation of the products in the online shop
The presentation of the products in the online store is not a legally binding offer, but a non-binding online catalog. You can place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained for this purpose in the order process. By clicking the order button, you place a binding order for the goods contained in the shopping cart. The confirmation of receipt of your order will be sent by e-mail immediately after sending the order.
When the contract with us is concluded depends on the payment method you have chosen:

We accept your order by sending a declaration of acceptance in a separate e-mail or by delivering the goods within two working days.
During the order process, you will be redirected to the website of the online provider Apple. There you can enter your payment details and confirm the payment instruction to Apple. After placing the order in the store, we will request Apple to initiate the payment transaction and thereby accept your offer.
Credit Card (VISA, Mastercard, American Express)
When you place your order, you provide your credit card information and the credit card company performs an authorization check. Once you have been verified as a legitimate cardholder, the payment transaction will be initiated automatically and your credit card will be charged when you place the order. At the time of the credit card charge, the contract with us is concluded.
During the order process you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After submitting the order in the store, we request PayPal to initiate the payment transaction and thereby accept your offer.
Klarna Pay Now
After placing the order, you will be redirected to the website of the online provider Sofort GmbH, where you confirm the payment instruction. This concludes the contract with us.
In the order process you will be redirected to the website of the online provider Google. There you can enter your payment details and confirm the payment instruction to Google. After placing the order in the store, we request Google to initiate the payment transaction and thereby accept your offer.
After placing the order, you will be redirected to your bank's website, where you will confirm the payment instruction to your bank. This concludes the contract with us.

3. Contract language, contract text storage
The languages available for the conclusion of the contract are German and English.
beckaya e.U. keeps these General Terms and Conditions and the other contractual provisions with the order data in the ordering process ready for retrieval. Customers can easily archive this information there by downloading the General Terms and Conditions and saving the data summarized in the order process in the online store using the functions of the browser. Furthermore, the General Terms and Conditions can be called up at any time in the online store.
The contract text is not stored by us.
beckaya e.U. offers a password-protected direct access ("Login") for each customer. Here customers can manage their data and view their placed orders with the appropriate registration. The customer undertakes to treat the personal access data confidentially and not to make them accessible to any unauthorized third party.
4. Delivery conditions, availability of goods
Shipping costs are added to the stated product prices. You can find out more about the shipping costs in the offers.
We deliver only by mail order. A pickup of the goods is unfortunately not possible.
We do not deliver to packing stations.
beckaya e.U. sends the ordered goods within 10 business days after receipt of order. Possibly deviating delivery times are indicated on the respective product page.
The obligation to deliver is not applicable if beckaya e.U. itself is not supplied correctly and on time due to force majeure and is not responsible for the lack of availability. In case of unavailability of the goods beckaya e.U. will inform the customer immediately and, if necessary, suggest the delivery of a comparable product. If no comparable product is available or the customer does not want a comparable product to be delivered, the seller will immediately refund any advance payment to the customer.
The delivery time shall be extended appropriately in the event of impairing strike measures and lockouts as well as other circumstances for which beckaya e.U. is not responsible, in particular in cases of delivery delays due to force majeure. We will inform the buyer immediately about the beginning and end of such obstacles.
5. Prices, shipping costs and cost sharing agreement
The prices stated in the online store are inclusive of taxes and other price components, but exclusive of shipping and delivery costs, unless otherwise stated in each individual case. The shipping costs are waived from a minimum order value of EUR 200.00.
The shipping costs & shipping conditions are listed on the website and are displayed to the customer before submitting the order.
For deliveries outside the EU, additional costs may arise when importing into a third country (customs duties, possible customs fees and import sales taxes). These other costs shall be borne by the customer.
Agreement on the bearing of costs when returning the goods: If the customer makes use of his right of withdrawal, he has to bear the costs for the return of the goods himself.
In our store you can use the following payment methods:
Credit Card (Visa, MasterCard, American Express, Maestro).
When placing your order, you provide your credit card details. After your legitimation as a legitimate cardholder, the payment transaction will be carried out automatically and your card will be charged.
When paying by credit card, the customer provides the following data: Cardholder, card number, credit card company, expiration date and CVV code. The data is transmitted via SSL encryption with at least 128 bit key and is therefore not visible to unauthorized persons. The entire processing of the payment is handled by the payment service provider Shopify Payments and guarantees that credit card data is neither processed nor stored by us. During the order process you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, legitimize with your access data and confirm the payment instruction to us. After submitting the order in the store, we request PayPal to initiate the payment transaction. The payment transaction will be carried out automatically by PayPal immediately afterwards. You will receive further instructions during the order process.
The entire processing of the payment is done by the payment service provider Paypal and guarantees that we credit card or account data is neither processed nor stored.

After placing the order you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have a bank account activated for online banking, legitimize yourself accordingly and confirm the payment instruction to us. You will receive further instructions during the order process. The payment transaction will be processed immediately by Sofort and your account will be debited.
The entire processing of the payment is handled by Klarna and guarantees that we neither process nor store account data.
To pay the invoice amount via Apple Pay, you must use the "Safari" browser, be registered with the service provider Apple, have activated the Apple Pay function, legitimize yourself with your access data and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. You will receive further instructions during the order process.
To pay the invoice amount via Google Pay, you must be registered with the service provider Google, have activated the Google Pay function, legitimize yourself with your access data and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. You will receive further instructions during the order process.

7. Right of withdrawal
You have the legal right of withdrawal, as described in the withdrawal policy.
8. Voluntary withdrawal
Notwithstanding the consumer's statutory right of withdrawal or cancellation or warranty rights, which are not limited by this provision and remain unaffected by it, beckaya e.U. grants the customer a voluntary right of return in accordance with the conditions in this section.
The customer has the option to return goods that do not meet his expectations (i.e. do not fit or do not like) to the return address indicated on the shipment. However, used, soiled or damaged goods are excluded from the voluntary right of return. It is also provided that attached labels have not been removed.
The return must be made within 14 days of delivery of the goods to the customer. Timely dispatch is sufficient to meet the deadline.
All returned goods must be sent back in the original packaging including all accessories. Goods that the customer does not return or missing parts in the return shipment must be paid by the customer.
beckaya e.U. will reimburse the customer for any payments made (purchase price and shipping costs for the return shipment). For deliveries with an order value of more than EUR 200.00, the refund of the costs of the Hinsendung is not applicable.

9. Reservation of proprietary rights
The goods remain the property of beckaya e.U. until full payment has been received.
10. Transport damages
If goods are delivered with obvious transport damage, please claim such defects as soon as possible to the deliverer and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to be able to assert our own claims against the carrier or the transport insurance.
11. Warranty and guarantees
Unless otherwise expressly agreed below, the statutory liability for defects shall apply.
In the case of used goods, the following shall apply: if the defect occurs after the expiry of one year from delivery of the goods, the claims for defects shall be excluded. Defects occurring within one year of delivery of the goods may be claimed within the statutory limitation period of two years from delivery of the goods.
The above restrictions and shortening of the period shall not apply to claims based on damage caused by us, our legal representatives or vicarious agents
- in case of injury to life, body or health
- in case of intentional or grossly negligent breach of duty as well as fraudulent intent
- in the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and the observance of which the contractual partner may regularly rely on (cardinal obligations)
- within the scope of a guarantee promise, if agreed, or
- insofar as the scope of application of the Product Liability Act is opened.

12. Complaint management
We attach great importance to customer satisfaction. Customers can contact beckaya e.U. at any time using one of the contact methods listed at the beginning. We strive to examine concerns as quickly as possible and we will contact the customer for this purpose after receipt of the documents or the input or complaint. In the case of complaints, customers can help if they describe the subject of the problem as accurately as possible and, if necessary, send copies of order documents or at least provide order number, customer number, etc.. If you do not receive a response from beckaya e.U. even within 5 business days, please ask. In rare cases, e-mails may have been "stuck" in spam filters or a message by other means may not have reached you or may have been omitted by mistake.
beckaya e.U. does not guarantee permanent availability of the online store at www.beckaya.com. To avoid damages caused by computer viruses or other malicious programs, the customer should use an up-to-date browser software as well as suitable protection programs in the latest version.
beckaya e.U. as an online shop operator does not take any responsibility for the content published on www.beckaya.com by registered members such as customers.
For claims based on damages caused by us, our legal representatives or vicarious agents, we shall always be liable without limitation
- in case of injury to life, body or health
- in case of intentional or grossly negligent breach of duty
- in the case of warranty promises, insofar as agreed, or
- insofar as the scope of application of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited to the amount of the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.
14. Data protection notice
All contracts concluded via the online store are subject exclusively to Austrian law, excluding (as far as possible) the UN Convention on Contracts for the International Sale of Goods. This choice of law includes that the customer with habitual residence in one of the states of the EEA is not deprived of the protection granted by mandatory provisions of the law of that state.

16. Dispute resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find here. Consumers have the option to use this platform for the resolution of their disputes. To resolve disputes arising from a contractual relationship with a consumer or whether such a contractual relationship exists at all, we are obliged to participate in dispute resolution proceedings before a consumer arbitration board. The association "Schlichtung für Verbrauchergeschäfte", Mariahilfer Straße 103/1/18, 1060 Vienna, https://www.verbraucherschlichtung.at is responsible for this. We will participate in a dispute resolution procedure before this body.
17. Severability Clause
Should individual provisions of these General Terms and Conditions be wholly or partially invalid or later lose their legal effect, this shall not otherwise affect the validity of the General Terms and Conditions. The invalid provisions shall be replaced by the statutory provisions. The same applies if the general terms and conditions contain an unforeseen gap.
